Introduction

This privacy and cookie statement applies to all processing of personal data by BeyondDutch and describes which personal data is processed by BeyondDutch and how it can and will be used. Personal data is understood to mean: All data concerning the User with which the User can be traced back directly or indirectly. The mentioned data and information within this privacy and cookie statement may contain personal data.

Through the Service of BeyondDutch, User will be able to gain access to for example films, series, local productions and trailers against payment and exclusively for end use purposes subject to the applicability of the Terms of Use applied by BeyondDutch. BeyondDutch is responsible for the processing of data in favour of the Website and the Service.

As will be clarified further on, BeyondDutch collects data about the Users when they sign up for the Service for the first time, when they go on to use the Service and during every contact between BeyondDutch and the User. Mentioned data will be (sometimes combined with other data) used to offer and invoice the Service, to improve the Service or to focus on a User’s personal preferences or to offer the User support and for other purposes defined within this privacy and cookie statement.

Definitions

Account: The personal registration consisting of the user name and the password with which the User gains access to the Service.

Devices: The devices specified on the Website on which Content can be played.

Content: Audio-visual material like for example films, series, local content, trailers and previews.

Service: The Service of BeyondDutch which enables Users to access Content through various Devices subject to the applicability of the Terms of Use applied by BeyondDutch.

User: The natural person not acting within the scope of trade or business that has access to Content made available by BeyondDutch.

Privacy and cookie statement: The current privacy and cookie statement applied by BeyondDutch.

How we collect data

BeyondDutch collects User data in the following ways:

Directly from the person concerned: For example when the person concerned signs up as a User to access the Service, if said person signs up for a special offer or promotion from BeyondDutch, if a User sends an email or contacts BeyondDutch by any other means with for example questions about the use of the Service.

As a result of using the Service: Anyone can visit the Website and Users have access to the Content with their Account. BeyondDutch uses cookies to collect data concerning the visit to the website. Through the Account, BeyondDutch can keep track of how the Users use the Service, including the Content that is viewed through use of the Account.

From BeyondDutch: To be able to use the Service, the User must first sign up and register. The data submitted by the User (for example their email address, first name, last name, date of birth and sex) will be saved by BeyondDutch.

From third parties: For example, when a Website visitor or a User uses social network functions that are integrated in our Service, BeyondDutch might receive certain data from the concerning social network, like for example from Facebook, Twitter or Google. BeyondDutch might also receive data from parties that handle payment for the Service on behalf of the User.

Cookies

What are they: Cookies are small files that can be placed by the Website onto the User’s computer or other Devices on which User plays the Content. This allows for easy recognition of a User during a next visit without having to log into their Account. Data of other Website visitors (not Users) can also be collected with the help of cookies on how they use the Website. There are different kinds of cookies. Insofar as BeyondDutch collects personal data through the use of cookies, said personal data will be processed in accordance with the provisions of this privacy and cookies statement.

Which cookies are used by BeyondDutch: BeyondDutch places cookies in the interest of the Service to recognize the User during his next visit without the User having to log into his Account. NFN also uses third party services to analyse the use of the Website. These third party services also place cookies on your devices, which are used to create reports on aggregated level about how visitors use the Website. It is possible that in the future, other cookies may be placed by the Website, BeyondDutch or others.

Third party cookies: Third party cookies have been made by or for third parties and will be saved on your computer or other Devices by third parties. Only these third parties have access to the cookies and the data that is collected by these cookies. Third parties that are able to place cookies through the Website are for example social network services like Facebook, Twitter and Google. This happens through the buttons that may be offered on the Website to promote or share Content with others.

The data we collect from users

BeyondDutch collects and processes the following User data for the purposes clarified elsewhere within this privacy and cookies statement:

Contact details and Account: BeyondDutch saves the data submitted by Users upon signing up for a subscription (i.e. email address, first name, surname, date of birth and sex) or promotional offer. Required data to be submitted will be indicated during the sign up process.

Payment data: The party handling all payments for BeyondDutch will save information on behalf of BeyondDutch about (the method of) payment and invoicing with regard to the Service (for example credit card details or bank details in case of an authorized direct debit).

Data on the User concerned: BeyondDutch may keep track of the Content requested by User.

Data on the use of the Website and the Service: BeyondDutch may also collect more general data on the use of the Website and the Service by Users and Website visitors, for example by keeping track of how often and from which IP address a User logs in, with which browser the Website is visited or the type of Device used to request Content.

Data from the app(s) of BeyondDutch: With the use of the app(s) of BeyondDutch on a mobile Device, the unique identification code of said Device may be registered. BeyondDutch may also register the type of Device or the version of the operating system that is used. BeyondDutch may in addition also register the use of the app and where it was downloaded.

Data on email responses: When BeyondDutch sends emails to Users, data may be collected on the way the User responds to said email, for example how often the email is opened or how often the links within the email are clicked on.

Data in connection with User contact: For example if User asks a question through email or contacts the helpdesk through other means.

How we use this data

To be able to offer the Service: BeyondDutch for example uses the Account to grant User access to the Website and the Content and uses other data submitted during sign up (like name and date of birth) to verify if User complies with the requirements. Submitted contact data may be used to inform User about for example amendments within the Service or scheduled maintenance (service emails).

For the processing of payments: certain data requested during the sign up is necessary to process invoicing and payment for the Service.

To identify preferences and to personalize the Service: BeyondDutch may keep track of which Content is requested through User’s Account and (partly) on the basis thereof, adjust the Service to User’s preferences that are indicated by viewing habits.

To improve the Service and to identify current trends: BeyondDutch uses data from all Users to analyse in broad terms how the Service is used and which trends can be seen through use to make better informed decisions on for example further development of the Service and the choice of Content. Also more technical trends may be used for this purpose, for example which type of Devices or browsers User uses to request Content.

To prevent misuse: BeyondDutch also processes data from Users and on the use of the Service to prevent misuse of the Service and the Content, to prevent fraud (for example with credit cards or payment methods) and to secure the rights of others (including the rights of right holders to the Content).

For market research: BeyondDutch may contact Users, Users that no longer use the Service and Website visitors that have submitted their contact details for market research. Participation in such research is always on a voluntary basis. BeyondDutch is entitled to send offers on the basis of this research to Users who have participated in this research if they have given prior consent to do so.

For marketing purposes: BeyondDutch may use contact data and other collected data to promote its own promotions or offers (promotional email) through telephone, post, email, text message or other media suitable for this purpose or to keep Users informed on the Service and the Content (newsletter emails). Users may unsubscribe at any time. Others, other than Users, will only be contacted by BeyondDutch if the Other concerned has explicitly asked for this by for example signing up to be contacted.

Compliance with the law and regulations: data can be used to comply with the law and regulations that apply to BeyondDutch, to handle disputes and to have (accountant) audits carried out.

For other reasons permitted or required by law: in exceptional circumstances, BeyondDutch may also use data for other purposes if permitted or required by law. For example if BeyondDutch is obligated to provide data to an order of the court or investigative authority.

With whom we share data

With (other) suppliers of BeyondDutch: BeyondDutch may forward User data to suppliers that are used to realise the Service.

With other partners of BeyondDutch: with User’s consent, BeyondDutch may provide data to other partners selected by BeyondDutch for marketing purposes.

With authorities and others: in exceptional circumstances, BeyondDutch may provide data to authorities or third parties if BeyondDutch is obligated to do so by law or to an order of the court, or if there are reasonable grounds to assume that this is necessary to prevent damage or misuse.

User’s rights with regard to their data

Users are entitled to disclosure of the data processed by BeyondDutch and have said data amended at all times and without cost. Users can also object to receiving information or specific offers from BeyondDutch by email, telephone, post and/or text message. If User wishes to use this option, he or she may do so by contacting the customer support.

Individuals below the age of 16

Individuals that have not yet reached the age of 16 (minors) may only sign up as a User with parental or a legal guardian’s consent. The parent(s) or legal guardian of the underage User should read this privacy and cookie statement on behalf of the underage User and may exercise the rights of the underage User on said User’s behalf. BeyondDutch recommends that parents or legal guardians supervise the use of the Service by the underage User and to make said Users aware of the possible use of their personal data in accordance with this privacy and cookie statement.

Data security

BeyondDutch will maintain a security level at all times during the processing of User data and that of Website visitors which given the state of technology is sufficient to prevent unauthorized access to, amendments to, public disclosure of or loss of personal data.

The Website may contain links to third party websites. BeyondDutch cannot be held responsible with regard to the use of personal data by the organisation(s) that provide these websites.
